If it's in a political context then no. That includes comments that are not overtly political but are clearly referencing political comments that Musk has made.

It will depend on how much he moves from business to politics. If we take Trump, he has moved publicly into politics almost 100%. If Musk does the same then the comment will only be seen as political. If he stays mainly as head of twitter, Tesla etc, then you can abuse away, within reason. I suspect he will be back to the business realm quite shortly so the issue will no longer be there.
