Should've called fore...

Negligence - "is a failure to exercise the care that a reasonably prudent person would exercise in like circumstances"

Would you have shouted fore if you was on the course and hit a ball towards someone?

Addition

"those who go personally or bring property where they know that they or it may come into collision with the persons or property of others have by law a duty cast upon them to use reasonable care and skill to avoid such a collision." Fletcher v Rylands ([1866] LR 1 Ex 265)

Obviously yes
But would it have made a difference - that's my point.
Someone 300 yards away shouting - if he'd been looking towards the tee he'd probably have seen the ball or the guy with the paddle behind indicating the general direction.
If he wasn't looking then why was he there..?

The law is the law - no problem there.

But shouting wouldn't have stopped this.

Think you should shout every time you hit one thats likely to get near someone... Shouldn't matter wether your an amateur or pro, girl or woman, man or boy... Distance away doesn't matter a jot either... Its just plain common courtesy...

Sadly there's no such thing as an accident these days... Seemingly blame has to be apportioned somewhere... Shouting fore won't necessarily excuse you from blame just shows you've still got an amount of 'decency' in you...

I would think he should have shouted fore , bust as Imurg says the guy was working there he should be paying attention , there is a guy with a paddle waving the direction as it was hit .. do patrons not have a responsability for their own safety also ?? if your standing along a fairway watching the player tee off you will see the people waving the paddle ..

So are you saying its the injured parties fault?

Of course not

But, notwithstanding the legal position, you have to either be on the ball and remain aware of what's going on or accept that you're in the firing line.

A shout is always the right thing to do - whetehr it actaully has the desired effect is another matter.

Rubbish, it's not like you're the only person there and some old biddy is walking her dog across the fairway. You can't shout at the top of your voice so people in the HEAVING CROWD might be able to hear you 300yds away if you might have Tiger Woods 100yds from you at the top of his backswing!!... get into reality.

When you play your 4-ball stableford off the yellows at the weekend and you hook one... shout by all means.

Not much chance of that, he wasn't even there. He missed the cut again

So the feelings of another professional should superceed that of the potential serious I jury incurred by not shouting!

No

Shout - it's the right and proper thing to do. And in the games we play, on the courses we play it should be sufficient.
But we're talking about a high-profile event where, after every single tee shot, some Redneck yells at the top of his voice some stupid remark.
How is a guy 300 yards down the fairway going to hear a shout of Fore over all that? 300 yards away everyone's talking anyway - you're not going to make out a shout from that far away.
There's always a Steward standing behind the tee shot. He waves his paddle in the general direction that the ball is going. If you're on that side of the fairway then you take cover. If you're not paying attention then you're going to get hit.
Yes he should shout
Yes the spectators need to pay more attention

I'm sorry to disagree but 300 yards with trees on either side will be a massive tunnel. I shouted on Saturday and i'm sure the entire back 9 ducked, so not having sufficient vocal power to make an audible single syllable word clear over 300 yards is not an excuse to not shout.Looking at the video, the guy is a steward who's job is to face the crowd to make sure no yank twit runs onto the fairway and jumps on the ball. So he shouldn't be watching the ball he has a job to do, BUT he should also have sufficient safeguards to ensure that one of his colleagues (Steward, Player or Caddy) has the decency to echo a FORE! if a ball is hit towards him!We are all humans, just because they are good at golf doesn't mean they should be different to the rest of us. Most golfers get a bad rep for being arrogant twazocks at the best of times...Surely we should be breaking the stereotype, not upholding it.
