The Grinder Of Pars (Semi Crocked)
Negligence - "is a failure to exercise the care that a reasonably prudent person would exercise in like circumstances"
Would you have shouted fore if you was on the course and hit a ball towards someone?
Addition
"those who go personally or bring property where they know that they or it may come into collision with the persons or property of others have by law a duty cast upon them to use reasonable care and skill to avoid such a collision." Fletcher v Rylands ([1866] LR 1 Ex 265)
Obviously yes
But would it have made a difference - that's my point.
Someone 300 yards away shouting - if he'd been looking towards the tee he'd probably have seen the ball or the guy with the paddle behind indicating the general direction.
If he wasn't looking then why was he there..?
The law is the law - no problem there.
But shouting wouldn't have stopped this.
