He isn’t a news reader/editor etc therefore he is allowed to do what he did.
The fact his contract isn’t up to task isn’t his fault.
He didn’t mention it on MOTD so didn’t abuse his position.
You can Google the BBC social media's policy. It makes it clear it applies to "all colleagues (employees, contractors and freelancers)"

Its not really as the statement that BBC released regarding Lineker stepping back suggests otherwise.

The BBC asked Lineker to step back after "extensive discussions with Gary and his team in recent days".

It "decided that he will step back from presenting Match of the Day until we've got an agreed and clear position on his use of social media", the statement said
.

It continued: "When it comes to leading our football and sports coverage, Gary is second to none.

"We have never said that Gary should be an opinion free zone, or that he can't have a view on issues that matter to him, but we have said that he should keep well away from taking sides on party political issues or political controversies."

I thought you would be up to speed with the whole notion of "independent contractors" based on all your LIV Golf related posts.

I am, so who employs Lineker to front MOTD?

This statement from the BBC on the BBC website might help you answer the question ;-)

“The BBC has been in extensive discussions with Gary and his team in recent days. We have said that we consider his recent social media activity to be a breach of our guidelines.

“The BBC has decided that he will step back from presenting Match of the Day until we’ve got an agreed and clear position on his use of social media.

“When it comes to leading our football and sports coverage, Gary is second to none. He works for an 3rd party company, which is then contracted by BBC to supply his services.

That isn't, full statement, as I just read on bbc website that they said he was in breach of their guidelines.

It's absolutely clear, he's breached the guidelines.

2. Rules and expectations of social media use for all colleagues (employees, contractors and freelancers)
The following rules and expectations apply to all those working for the BBC, for professional (@BBC) and personal social media accounts.

1. Always behave professionally, treating others with respect and courtesy at all times: follow the BBC’s Values.

2. Don’t bring the BBC into disrepute.

3. If your work requires you to maintain your impartiality, don’t express a personal opinion on matters of public policy, politics, or ‘controversial subjects’.**

4. Don’t criticise your colleagues in public. Respect the privacy of the workplace and the confidentiality of internal announcements.

It comes down to #3
Does his work require impartiality?
In football terms then yes it does.
On any other subject?
No, because it's not part of his job.
If he was a political correspondent then he would have to remain impartial
He isn't
So he doesn't have to.
If he said it while on TV or on a BBC website then he would be in trouble...
Elon doesn't own the BBC....yet

Give it up Mel. This is a reply about Andrew Neil's twitter use just 3 years ago

It shows the policy hasn't been broken
