Appeal against speeding fine

Get that Ken but asking learners who are doing 26 or 27 in a 30 why they're not doing 30 isn't sensible for me
He asked me to get close to the speed limit. 27/28 is close to the limit in town then. He didn’t like you doing 25 or less if the road was clear.

This was a Talbot Samba without dual controls. It wasn’t easy to speed in that thing. 🤣
 
From the OP it sounds like your daughter was driving too close to the lorry so she couldn’t see the gantry sign. The lorry slowed down because of the limit change so your daughter pulled out into a gap in the other lane to overtake, which resulted in another car being too close for her to break when she finally saw the sign.

The rest of it sounds like excuses.

Hopefully the worry for the next couple of weeks will teach her a valuable lesson.

Ah the infamous “Attitude test”

As a young looking 18 year old driving about in my dads Princess I used to get pulled over and given a producer regularly in the early 80s, I soon learned to take all my docs with me, talk to the officers politely and found I was on my way in no time. It’s a lesson I have carried throughout my life, you get more with the carrot than the stick.
 
We have a road sign here (a proper one) says: 'Its a motorway not a runway'

Which reminds me of a time I stopped a Porsche Boxster on a motorway, having followed it for over three miles at night at speeds in excess of 110mph.

Turns out the driver was on his way home from work at a local airport. He was an easyJet pilot (other budget airlines are available).

His reply after caution?

“I’m an airline pilot. I’m used to speed.”

Only time I ever got stopped was in '84...taking the girlfriend home and driving along the A40 through Wycombe towards Beaconsfield.
Saw the Panda behind so stuck rigidly on 4p all the way.....
After 5 minutes he pulled me over and asked me why I was driving at 40 in a 30...
I genuinely thought it was a 40 hence the constant speed...he chuckled and said that's what he thought was happening because I stuck to the speed..
Let me off with a Take care now Sonny.....
Those were the days...

I would have thought back then anyone under 65 seen driving a Princess would have been pulled..:LOL:
 
Lots of factors in play here. First thing to say is that the time to actually worry is when the ticket arrives, not before.

Back in the day, I seem to recall we were always told that it was a little overzealous to apply speed enforcement at the point of a change in speed limit. As such, it does seem a little unfair to have a camera flash anyone when the limit reduces at the same point. But that all seemed to change when variable speed limits became the norm on motorways. Now, it seems the requirement is that drivers only need have sufficient time to react to any limit change.

If you can argue that the speed limit signs at the gantry were obscured and allowed insufficient reaction time then an appeal may be successful, but I must say that argument may be ambitious given the fact the incident was on a motorway, where forward views are rarely anything less than considerable.

In my experience from the enforcement side, in the event that losing your licence is possible, then attending court in person, pleading guilty but then citing mitigation as to why a licence is so important is perhaps the best option. But the trade off is likely to be a hefty fine.

It does exist!

It perhaps shouldn’t, but I used to encounter one or two who simply refused to listen to words of advice, so enforcement became an option I would use instead.
Yes my mate was a traffic cop back in the day 😳 and he always said “ I would give you a chance to drive away if it wasn’t serious”
But far too many never took the offer.

You don’t get that chance with cameras !🎥

Question to the OP:

I assume by gantry you mean a structure that goes over all lanes? If this is correct, then most (all?) gantry’s have a matrix sign over each lane - how big was the tree to cover all the signs? 😄

The gantry has 2 matrix signs over 2 lanes if I remember correctly, the road approaching it is a slightly uphill left to right bend with trees all the way down the left, it's a fact that you can't see the matrix signs until you're clear of the trees, a bit unworthy of your smiley face if I'm being honest 😉

That’s a poor design imo.
On a bend there should not be trees blocking the view of safety features.
 
I had a look on Google Earth and, if I understand correctly, the location we are talking about here is the M90 slip road as it joins the southbound carriageway of the M9.

If I’ve got that right, whilst the date of the imagery is unclear, I can’t see any cameras on the gantry as you approach the left hand bend, or the one as you are exiting it near to the M9.

EDIT: The imagery is dated May this year.

Gantry is on the M90 about 500 yards before the slip for the M9 south. Camera is side mounted on the gantry. Once you start down the slip (where it splits for M9 north) there is only the underpass camera at Newbridge on the M9.

ETA, there is a second gantry that covers both carriageways at the slip, this doesn’t carry a camera.

Thanks Bb, that is the one in question, to the lower left side of the gantry on the side of the gantry you see in your mirror as you pass under it there is a yellow pole protruding with two, with what I took to be cameras, yellow boxes attached about 5 or 6 feet apart
