I know the prosecution could not mention the guy who was shot previous history.
But and this is a massive but. The CPS knew he was due in court in 10 days time for the shooting of another gang member. Did the CPS Gamble with this poor bloody policeman’s life to see how this unfolded knowing the killed guys past history would unfold the way it has. What also bogged me off was the judge stopped the jury from releasing a statement. Along the lines of this should have never come to court. Why?
To answer the first part, Tash, I doubt it very much. There are very clear rules regarding the use of what is called bad character evidence, and I don’t even know for sure they would apply to the deceased in a murder trial anyway. The CPS will have considered the case against the officer, not pending cases against Kaba.
As for the second question, I don’t know is the short answer. I suspect there are legal issues surrounding it, but I have never heard of juries releasing statements.
