Motor accident - Personal injury claim again

My wife was involved in a motor accident in January which basically came about as a car broke going thru a green light, car behind bumped into it & finally my wife was the last into the bump - Not a lot of damage all round.

Being the last car into the bump the police appointed the blame against my wife & the accident was demed her fault legally (bizzare)

7 Months down the line we just received a letter from the passenger in the middle car's laywer via claiming 5K against my wife personally.

Not able to speak to the insurance company till Monday as only the accident reporting department open at weekend.

Does anyone know if this cost is covered under the 3rd party part of your insurance policy or is she going to have to stump up 5K herself.

Apparently supposedly being unable to go to bingo is worth 5K (actually listed that in claim!!!)
 
Most common occurrence nowadays I'm afraid. The legal parasites that perpetrate this type of claim should be disbarred IMO.

The insurance companies that sell on details of accidents to the legal/claims companies should also be held to book.

It should be covered in your insurance, but you will need to speak to them next week. We had a company chase my wife when she didn't make a claim after a rear end shunt. Went on for 12 months until we told them to do one !

was rear end shunted Sept 2009 in a new car (1 day old), had calls for months offering upwards of £3k if we made a personal injury claim,

ambulance chasing at it's worst, thanks America
 
Under no circumstances respond to the claimant or their 'agent'... Just pass all correspondence received to your insurers to deal with... Thats what you pay your premium for and they may possibly try and wriggle out of their responsibilty if they feel you haven't acted correctly...
 
Saw a typical case of this in one of the police programmes last week.
The policeman doing the speel voiced his obvious displeasure about the, now normal whiplash claims following a shunting. At the same time a fire crew were cutting an entire family from a car where they were all claiming they were injured. The officer stated that there was probably nothing wrong with any of them but they kept up the pretence in order to lodge their claim.

Certain members of the community appear to be forging quite a living filing claims for whiplash and other back and neck injuries.
 
I'm not an expert but I think she ought to be covered. 3rd party should cover all costs against your wife but not to her own property if it was her fault.

I hate to say this but if your wife had allowed enough space between her and the car in front she wouldnt have crashed. Thats just the way it is.

A friend was a witness to an accident a while back. The statement said they witnessed the injured party leaving the vehicle, having a cigarette then getting back into the vehicle, the fire sevice arriving and having to cut them out due to serious injuries!:o

A couple of years ago I was driving my wifes car when this woman came out of a car park without checking that the pedestrian lights in front of me were on red.
She swerved and caught the edge of the bumber which was slightly damaged and was replaced. Barely noticed the bump and the woman was most apologetic.

Since then I must have had 50 telephone calls and texts telling me I could claim up to £5k damages, I finally lost the plot and persued the callers to director level and told them exactly what low lifes I thought they were and if they rang me again I would seek the police advice on harrassment.
No calls since!!
 
I was in a shunt this year, a woman stopped mid roundabout and I hit her from behind, the car behind me then mullered into the back of me.

I was in my work van, put on hazards and beacon, put out cones behind the 3 vehicle (Audi TT' do not like transit rear steps)

The woman in front barely even spoke english and for the life of me I have no idea why she just randomly stopped after pulling out onto the 2 lane roundabout. I gave her my details, she jumped back in and drove off. The woman behind was shaken and I waited until she was towed off the road. I had numerous calls from my employers fleet insurers as they had suspicions about a possible claim from the vehicle I hit. I wish I had not let her drive off and called theold bill. there was no damage to her car as I barely bumped her but she must have been on a dodgy licence as to just stop like that and claim she thought traffic was coming when it was so clear the 2 cars behind both pulled onto the roundabout speaks volumes.

I never even thought about claiming against the vehicls that hit me but have had plenty of texts and vm's on my work mobile so obviously the details must be sold on somewhere!
 
I rear ended at less than 10 mph a mercedes sprinter with big step on the back, the driver jumped out had a good look round his vehicle underneath crawling round.

His employer said they prob wouldn't claim. After a week I finally got message that he was claiming for whiplash and back injury. I then called my insurer to inform them of all the circumstances.

I also told them of the call i made pretending to be a customer when I asked for the driver by Name at APC Express Couriers in Liverpool. They said he was busy loading his van ready for tomorrows deliveries, I then told them I needed to deal with sometihng on another line and hung up. What I never told them was that I recorded the call, I passed the recording to my insurers who are fighting the claim and also the insurers of APC may be taking legal action against the driver for fraudulent claiming as he said on his claim form he couldn't work for 3 weeks.

Swings and roundabout, I hope he loses his job for being such a scrote.

Surely your not trying to defend the criminal actions of this clown? Thanks to him and people like him, insurance companies now have the excuse to charge us all through the nose for car insurance. Whilst it may be a shame for his family if he looses his job, he has brought this about by his own actions, not the actions of stevelev.

I see the reply's here and think has anyone been involved in a shunt or accident ? you are waiting at a roundabout and the daft old bint hits into the back of you at say 10mph whilst you are looking right to see when it is clear, Now tell me whilst your head is in that position and you get shunted believe me it is a sare yin, not right away not even a day later but 2 or 3 days down the line you are off work as it hits you. And some do not think you are entitled to pain and suffering or lost wages. It does not have to be a big shunt or accident it depends on how you are sitting at the time you get hit. Yes there are many out there who are at it but do not class everyone in that bracket.

Rubbish! If costs go up then those costs are passed on to their customers. Insurance companies are busineses out to make a profit lie any other.

Sydney, its not many, its the majority of injury claims. Asfar as personal experience goes, i've been a proffesional driver for more than 20yrs. In that time i have covered more than 1million miles all over Europe,and never had a point, or indeed an own fault accident.
I have however had many a clown drive up me jacksie at roundabouts/junctions, and idiots pullout of side streets and drive straight into the side of my 40ft vehicle claiming they never saw me:confused:.

In all that time i have never once made a claim. Why? Because i haven't been injured. Shaken/annoyed, you bet, injured no. However over the last 10yrs, virtually to a man/woman, the other people involved have, even though the accident has been their fault. Were they injured at the time? What do you think.. ;)

It just doesn't make sense when at a time when car safety features are the best they have ever been, that the incidence of PIC s' are at their highest level ever. Something just doesn't addup.

Have to disagree Stuart .. thers one person out of order in this scenario , the guy claiming for not been able to work , while he is working ,,

Insurance ,SHOULD be there to help those who need it. not free loading liars & cheats .. the guy didnt care much about Steve , did he ? personaly i hope he gets done for fraudently claiming .. BUT thats just my opinion ...
 
I'd be quite interested to find out how many/what percentage of whiplash claimants hadn't checked their head and neck protection was correctly set up for them. My understanding is that a correctly set up headrest cuts down most of the whiplash damage caused by a rear end shunt. I'll bet most of people just hop in their cars with the headrest in the same position as the day they bought it!

Not a road safety freak but as much as I could do with trousering a few grand of someone else's hard earned the missus would be ready to kill me once the golf withdrawal symptoms kick in!

If your claim is genuine Sydney yes , hey over here now in the event of many slight accidents its call my solicitor , oh and while your at it call an ambulance with a stiff colar aswell .. if your injured or out of pocket because of someone elses neglience then you are entitled to compensation , if your not , your not...

Big problem you get over here is if both parties are with the one insurance company , they just settle it & increase your policy without argument , they aint gona sue themselves ..

Excellent - good for you. One of the best courses of action on this kind of thing I have seen in ages.
