Had the same with mine, paid £80 for mine and leaked constantly. Got refund of my £80 as shoes are now discontinued, gutted though as bought just after new year when the sales were on. After 5 weeks of leaking they got sent back and took 4 weeks to sort. Once sorted all the sales were finished! Ended up paying out the extra £10 and got some some Nike lunar controls, no braking in straight from the box, no probs so far.

What is being said is not that he should get the rrp money back but offered the equivilent in product. The retailer wins here though as he gets all the money back and gives us back the sale price.

If they were Footjoys you may of had additional warranty in addition to staturatory rights. I know for the US waterproof warranty they replace like for like or provide equivalent shoe within the first year. This additional warranty is with the manufacturer so is something that you could go directly to Footjoy with. Not sure of the UK wording for the warranty though I'd imagine it is similar.

I think FJ have acted quite reasonably in trying to fix the shoes, but if they can't, I don't see way you expect to get more back than you paid. You bought what you thought was a bargain and it didn't work out. Get over it.

Where does it say you are entitled to a replacement pair?

What is the opinion of the forum, am I being unreasonable in not taking the refund or do you feel that I bought a pair of £100 golf shoes and so should end up with a pair of equal quality.

You never though, you bought a pair of £50 shoes. If you bought a television then 2 weeks later it had been reduced in price by half would you go in and ask for your money back?

From my point of view, all I wanted was the item that I had bought and would have been happy if it had been repaired or replaced. It was only an unusual situation in that most people go into these situations looking for a refund whereas it was the only option that I did not really want.

Anyway, great credit to both companies involved. The retailer called FJ who agreed that I should have a pair of the shoes that I had bought and immediately credited the retailer for a new pair. Retailer had dispatched the new shoes by 9.30 this morning and I will get them after the bank holiday.

WIN!!!

Bought a pair of shoes on special offer a couple of weeks back however noticed the price had gone up this week & glad I did, I went round smartish to give them the extra money, phew that's a weight off!!

:)

Those shoes are guaranteed for 12months regardless of how much he paid for them, so if they've developed a fault which they have then he should be offered a replacement like for like or a refund for what's on his receipt.

I don't know what the legal position is on this but I would say that the above is pretty fair comment. But I agree with the comments about any refund only being £50. I would say that the RRP or whatever is irrelevant, the fact remains that the shoes cost £50.

I would expect a company the size of FJ to replace the shoes without any quibble. After all, they give away 100's of pairs a year to every Tom, Dick and Harry on the various tours.

To add I think that FJ have done the decent thing, the retailer is passing the buck & don't deserve any credit in this

Can I ask the OP (or anyone else who supported the replacement over refund view point) say the OP paid £200 for the shoes & the current equivelant is £100 (just as good if not better quality etc) do you still just want a replacement!!

Was the Op right to ask & challange the decision, absolutly, was he entitled to anything more than a refund of money paid or replacement? No (& its not his choice which)

You managed to get a better deal & that's great, we should all haggle more

Motto here? avoid that retailer!

The retailer has been very good and is going back to FJ to ask that the shoes be replaced with this year's model of Contours as they agree that I bought a pair so should end up with the same or a similar pair of shoes.....

Just re-read this from the opening post & dying to ask, what stopped you selecting a pair off the shelf there and then? The retailer had just given you their permision to do just that!

Through either skill or ignorance the retailer has passed the warranty buck, a nice way of telling you to sod off you're getting nothin from us and have done so in such a way that you've ended up complimenting their efforts ;)

Shame on them!

It was an online retailer who normally offer excellent service and I will still use them as I still believe that they are a good company.

Just to emphasise, I was not looking for a refund of the full value all I wanted was the shoes that I bought as they were comfortable and I liked them. I would have been more than happy if they could repair them, I was not after a new pair in particular, just a pair and ideally my pair back and mended.
