Footjoy 1 year waterproof guarantee

Bought my daughter a pair of footjoy Myjoys Dryjoys, so these are their premimum ladies golf shoes. She doesn't wear them all of the time as has another couple of pairs of different shoes. About 3 weeks ago in the heavy rain she came off the the golf course with soaking feet after wearing these shoes. On close inspection you could see that the leather upper had split from the sole. I took them back to the pro shop we bought them thro and he sent them back to footjoy. Last weekend we had the answer back that they would offer 50% of the original price because the leather was scuffed on the toes of the shoes. They are white golf shoes and all my daughters toes get scuffed up due to the way she roles her foot on the follow thro of her swing.
To me this has nothing to do with the fact that they leak after 10 months and the leather has split from the sole.
What premimum shoe can i buy for 50% of the value ? A'm i being unreasonable thinking that footjoy are not fulfilling their year waterproof guarantee.
I will defenitly not be buying her anymore Footjoy golf shoes.
 
I wouldn't accept the offer.

I would be telling the pro shop that the guarantee has been breached and under the Sale of Goods Act 1979 you will sue them (the pro shop) for a full refund. It is clear that the reason for leakage is not connected to the answer that Footjoy gave.

If they do not play ball, a 7 day "Letter before action" is required to the pro shop and you could include Footjoy into the letter and summons as well as neither will want to do Court for £100'ish. It is important to send all the correspondance to the correct names etc but a 7 day letter is normally productive. If they dont respond you can these days do a Money Claim Online but you are obliged to do the Letter Before Action first
 
So is it the pro shop that is in breach or Footjoy ? Its very hard to bring action against your clubs pro shop. Dont think it would go down too well.
 
All good advice above (got vauxhall to pay for repairs on a car 2 years out of warranty on the basis of a car not being fit for purpose) however if you paid for the shoes by credit card you can save yourself a lot of trouble by raising the issue with your card issuer. Whilst section 75 cca only applies if your purchase was over 100 (card issuer jointly and severally liable with retailer which will guarantee you a full recovery)the retailer will still be liable under the terms of its merchant service agreement ( probably) and most card issuers will put up a bit of a fight for you - sadly the high street banks usually offer the poorest support. All it will take is one phone call and at worse a short email. Remember whilst the shop may/ will try and blame footjoy it is them that is liable - their recourse is against the manufacturer and not yours.

But the OP bought the shoes from a shop, it's the shop that should refund / replace in the first instance then they (the shop) claim from Footjoy. It's how the SOGA works.

OP - do not let the shop fob you off.

This is 100% correct as I am a retail shop owner.

However, they (the pro shop) do have the right to send them back to the manufacturer or supplier to make sure that it is not consumer error.

If a report then comes back and the manufacturer has decided it is consumer error then any charge against the shop will not stick.

Shops will not want to lose future business so sometimes will take the hit but they don't have to if consumer error has been reported back to them.

The SOGA is there to protect the retailer (seller) just as much as the consumer (buyer)

Agreed, but the report has to be correct and certainly can be contested. I don't see how the toe being scuffed has caused the upper to split from the sole but would stand to be corrected.

I agree, my point was, that its not a simple case of open season on the retailer as the retailer would be left with a loss hence the protection is there for both or all 3 parties.

What would happen in that case is that the shoes would have to be inspected by an independent company for an assessment and if the outcome of that was not accepted, it could go to arbitration.
 
Footjoy more like Footcrap. I had a pair of Footjoy and they leaked, I think they are crap and would not buy another pair.
Personally I think Footjoy are not playing game and you should pursue this as the shoes fall short under trade description.
The best I've had are Ecco Classic Saddle with GoreTex. I've had them 3 years and they have never leaked and I play golf ALL year round and in our winter league. Ill soon need a new pair Soley because of wear. Cost £100 and well worth the money I will certainly be buying another pair.
May seem expensive but I've certainly had value for money as I play golf about 3 times a week. You only get what you pay for
