Could you not request the appearance of the 'witness' the barmaid used at your appeal and try and prove that he was ... eh .... a liar? Accept the other punishment but try and plea bargain against the ban.

Clubchamp, I'm an ex-lawyer, too and GB72's advice seems sound.

Private clubs and associations can pretty much do what they want to you so long as they don't act outwith the terms of their constitution or for unlawful purposes. They probably have the right to suspend you so it's a matter of taking it on the chin this time. Anything else isn't worth the time and effort. It'll just make you bitter.

Is there no chance of early parole for good behaviour?

The thing is guys I wouldn't mind taking it on the chin but it's the fact that she used a false statement from a guy who didn't give her permission.
Plus she used 2 other items against the other guy on hearsay. She admitted that she was told the other stuff and we think the committee should not of used this. So we think this set the tone of the meeting, these guys read this and had just 1 thought in their minds.
I wouldnt be going to a solicitor against the club it would be against her, for using false statments to get us barred!

I think you and your co-accused need to appear infront of the committee in person to explain your version of events and highlight the fact that this boot seems to have falsified a statement from a 'fellow golfer'. Then if she will not retract her complaint, perhaps you could inform her of the option you have of seeking legal advice due to the fact she has besmirched your reputation and character in a golf club you have been a loyal member for 27 years and have an impeccable disciplinary record. If that doesn't work I think you should call for an E.G.M. and have a vote of no confidence in the committee.

If that fails, there is still the option of hunger strike, or even start your own movement. Dress up as Batman and call yourself;

Cheers for than andy, typical you putting a light hearted slant on it.
We have appealed so hopefully we will get the chance to call witnesses and put our story across. We're hopeing that whenever the guy retracks his name as it was used under false pretences we're hopeing that the council will throw her complaint out. Hardly likely but we all live in hope.

GB72, I was talking to a guy yesterday who was asking his solicitior about what had happened and about how the club had handeled it. The solicitor seems to think that the club have breached our civil liberties, but not letting us see the letter of complaint.
Do you have any thoughts on this?

I went to see a guy today and he seems to think that if the guy whose name was used under false pretence's takes nothing to do with it and says as much, he seems to think the case should be thrown out, but knowing the club and the barmaid they will have a reason and will get out of it some way...........here's hoping

You seem to want to drag this on, yet you claim that you wont miss the course at this time of years due to holidays and the weather.

Club committees can do whatever they like if they stick to the constitution that is in place.

From my experiences with committees you will not win. I have had a similar incident involving a lady captain where I was not even there yet I had to write a letter of apology.I was named as being in a group who hit through the lady captains group on numerous holes one day. The lady captain named me as being involved and I was threatened with expulsion unless I apologised. I was suspended until I wrote a letter! I left the next year due to this.

I now dont get involved in club affairs and generally change my shoes in the car park, play my golf and go. I am at another course now but still chose to do this. Will happily go for a pint after a medal with my partners or take guests in but if I'm only out for a whack I dont even bother going into the clubhouse.
