Another car insurance question

Wife parked her car in the local retail park to go shopping. Car parked legally, and neatly in a designated bay. Comes back half an hour later and some kind soul has put a nasty dent in the front wheel arch and damaged the corner of the bumper. No witnesses of course, and no note admitting liability. Insurance company are sorting it but have received a letter from them today stating that they are looking at it as a "fault liability claim"..... How can it be classified as this when the car was parked legally and we weren't even present when it happened???
 
Apologies if it’s an obvious question, have you checked the shops for any CCTV?
