I am not, nor indeed would I ever try and lay the blame on anyone in this situation - in this scenario nothing happened. There is no blame to be laid on anyone. However had I been struck by lightning then there would be only one person to blame. That person would be me.

"I know we were complete wazzocks for stupidly carrying on but here's the thing. Was the club negligent in its duty to us as customers in allowing us to "call it" on the day ourselves?

Personally I think it was, as had one, or indeed all of us been struck by lightning, would it not have failed in its duty of care by not stopping us using its facilities."

I hate to disagree, but the quoted words from your original post seem to go against what you are now saying.

Ah, but here's the thing. You are confusing blame with negligence.

I believe and would state categorically that they or indeed any course adopting a similar policy is negligent (in my opinion) and I would also say in the eyes of the law too. I blame this particular course for nothing. Nothing happened.

All service providers and commercial businesses owe a duty of care to their clients and customers. By seeking to absolve themselves from this by letting us use their service (the course) but decide for ourselves whether to play in the storm, despite them knowing full well that we may have been killed in doing so, would not cut it were a case ever to be brought by customers (not us) in the future.

They would inevitably be asked what steps they took to mitigate against the injury or death of their clients during thunderstorms. A response such as "We do nothing and just let them make up their own minds as the're grown men, Your Honour" would not cut it, set against the irrefutable facts that most similar businesses have a procedure to cover this circumstance (blowing a klaxon etc.)

They were to *blame* for absolutely nothing whatsoever.

And now....:whoo:
