Well yesterday I was trying out a driver that one of my mates was going to sell me. He tinkers about with clubs and is a bit of an anorak when it comes to club fitting etc so he fitted a new shaft to the driver head that he thought would suit my swing and was hoping to sell me the club for £120.00. Well anyway i was out on the course with a mate from work yesterday and things were going good until the 13th hole when i hit the driver and the ball went one way and the head shot way right into this massive gorse bush after looking for 45mins we could not find the head so I am only left with the shaft. how do i tell him what happened and is it my fault and should i pay for the driver or just explain what happened and give him the shaft back most of the cost was in the club head rather than the shaft.

what would you do in this situation.

Then blame his shoddy workmanship :lol:
 
I agree with above. 'All care; No responsibility' is the proper approach imo. Different if I ask to borrow a club though, but that's me.

Plus...Cut down Gorse bush and hand it to him, saying 'It's in there somewhere!'!:whistle:

Funnily enough this is exactly what happened to me this weekend.

I had done a deal with another former, to pull the heads of two 3 woods which he would keep and fit a Callaway adjustable hosel on to my Prolaunch red shaft out of my old Mizuno Driver.

All was well for the first couple of hits with it on Sunday afternoon, but as the course is very short you don’t need driver on all but 3 holes on the way out and as all the tee’s are still well forward there is no trouble in front of any of the tees. That is until you get to the 12. On the hole the winter tee is on the Ladies tee box and running a good 100 yards ten feet to the left is a collection of gorse and bramble.

Hit my drive a funny noise and the sight of the Callaway X hot Driver head disappearing into the middle of said Gorse. Looked for it for a good 45 mins no sign. My playing partners wanted to head in. so dropped my clubs off, got the dogs and headed back out. Still no sign of it before it got dark. Bumped into one of our Summer starters and he is often out ball hunting on a Monday so he said he would have a look for it.

Luckily I got a text from him late on Monday morning saying it had been found.. phew.

The person who fitted the shaft for me was very apologetic and offered to replace and could not work out why the glue had not set!!!

To be honest if you were trialing a driver from a shop and this happened I imagine the shop would expect you to pay for it, just like if you had damaged it.

So I reckon you owe you mate a driver head

i phoned just a few minutes ago and was rather shocked that it had fell of because its the first time anything like that has happened to any club has done. anyway as it stands he has told me that unless i find the head then i have to pay for the whole club not sure if this is fair or not. do you think i should pay?

i have told him that i will go have another look and asked if he wanted to help be but he told me it was down to me to find it, wish i had not bothered getting it off him now.
 
I'm sorry but I wouldn't be paying for it.

Think of the same scenario at AG on the driving range. They tape a club up for you to try and after several shots the head flies off. Do you now have to buy it? I think not.

But then you'd be dealing with a business trader and the 'Sale of Goods Act' would apply. I don't think you can claim 'goods not fit for purpose' so easily on a private deal.

I agree with you but he has said if i get the head he will glue it back on but if i cant find the head then i have to pay in full. looks like i will need to take cleanstrike's advice and get right into the bush.
 
Easy to see from both sides here, maybe best to have another look and if no joy then negotiate that responsibility is shared and pay £60
 
Personally I think your mate is wrong here.
It was me that swapped the shafts for Patrick and fitted the RAZR FIT tip sleeve.
I have done literally hundreds of shaft swaps and always use the same two part epoxy (Unibond Rapid) mixed in the same ratio using a set of marks on the mixing block and this is the first instance of a shaft detaching from a club.
I stress test shafts using a torque wrench and the shaft puller and it passed that.

However, despite all of the above it was my workmanship thay failed for whatever reason and therefore my responibility and i turn liability had Patrick incurred a loss. Not great but the reality.
Your mate needs to accept responsibility IMO.

Private car sale, you take a car for a test drive with a view to buying, the wing flies off during the test drive and is lost. I don't think you would now feel obliged to buy the car.
