Does anyone know if you have handed in your notice at work but have accrued holiday to take is a company obliged to let you take it during your notice period?

From the .Gov web site Paul

During their notice period the worker may be able to take whatever is left of their statutory annual leave.

The company do not have to allow your holiday if not booked and it will have a detrimental affect on your job. You just get it paid in final salary when you leave

I guess it will depend on how much the company needs you and/or have prepared for you going; rules in the company handbook (everywhere I've worked it's always been holiday "request"); and how many bridges you are happy to burn.

In my current employer I've seen immediate gardening leave just to get the person out the door. I've seen the month made up of 2 weeks notice and 2 weeks leave. But I've also seen all leave refused and the outstanding leave already earned bought off the person in their last pay packet.

Interesting, I did not know that. Not necessarily a good idea for a company to have a disgruntled employee working days when they feel they should not be. I doubt many are productive in those circumstances and so it would be a bold move to enforce it. I get that it may happen in some cases however (y)

Not obliged to let you go but often required and sometimes contractually forced by the company, especially if the intention is to send you on gardening leave. Some employees like the idea of being paid out for their accrued holiday in their last pay cheque. Many have already negotiated permitted paid time off with the new employer for any holiday already booked and so a lump sum from their old employer is a nice bonus. Many employers would rather not pay out what can be a few weeks of extra salary and so look to make the employee take their holiday as part of the notice period.

Thanks guys. I know they dont have to make you take it but didn't know if there was an obligation if the employee asked for it. Got an exit meeting with the manager tomorrow so I'll see what happens, basically i hate my current job so want to get out asap!?
