Help- Any legal experts around please?

We booked a 2 night break at a hotel in Barmouth total cost £172.

When we looked at the room it was not satisfactory and returned to reception and said we would stay 1 night and they agreed a refund for £86. Unfortunately rather than recriditing my credit card they took a further £86.

They have refunded the £86 but are only considering a partial refund for £43. Obviously a FULL refund was agreed by the member of staff on reception, the Agent of the hotel and if I had checked the refund form everything would be OK.

They state they could not resell the room and need to speak to the member of staff.

What are my rights please?

Whilst the amount is relatively small there is a principle involved
 
The person on reception made an inferred contract with you. Proving it is difficult unless you've included it in email correspondence with them and they've acknowledged it was wrong by their member of staff to offer that. You could also lodge a complaint with your credit card company but, again, you're going to need some proof.

Surely it is not difficult to prove if the member of the reception staff gave me a refund albeit she took the money from my credit card in error rather than refund
 
Go to the top of the hotel chain and complain. Tell them what happened and that you are not happy. I am quite sure that they will reimburse you and may even offer you compensation.

They wil be fully aware that you have access to social media and that you can do a great deal of harm with negative feedback.

If you are right then stick to your guns you should get back what you are asking for, especially if ithe hotel is part of a chain.
 
Personally, I would find the company on twitter and facebook and make them aware of the situation in a public manner but without divulging all the facts. I'd make it clear how you have been treated and that you feel that you have little alternative than to flag it up in this way.

I had an issue a couple of months ago with a trip to Disneyland Paris. Both the travel agent and Disney were fobbing me off via email and phone calls. As soon as I put something on twitter, the press department were in contact with in hours offering help.

I'd always give someone a chance to sort it first but definitely threaten media exposure if they fob me off
 
What has not been said is that because you paid by credit card, they have joint responsibility for " the quality of goods". You may be able to set a dispute with them. They will have details that they took another payment when in fact they should of been giving you a payment back.
I say May because we set up a dispute with Santander re having to pay for a hire car twice in Italy, Santander told us how to set up the dispute saying we should not of had to pay twice, but then told us we had no case. The bit that wound me up was not telling me why. They did however tell me to contact the company, which we already had, but we're not playing ball, which is why we ended up at Santander. Am Not risking an infraction giving thoughts on the T*****s at Santander.
 
Thanks for your help guys.. Have been unable to speak with person involved at hotel as she is not there today and does not return calls!

Spoken with Which Legal and they are in breach of agreement and hopefully they will take the common sense option.

Do not wish to embarrass them re posting on Facebook/ TA etc but may mention when discussing the situation.

Really appreciate all the help
