The above scenario occurred in a match last night and we weren't sure what to do after a quick look at the rules app.

Did he have a free drop at nearest point of relief or not?

As the ball was touching the stake it was in the water hazard.

If the stake was not movable or was declared by Local Rule to be an immovable obstruction he gets no free relief and must play under any of the options in rule 26.

If the stake was movable, he may move it but the ball is still in the WH.

The stake was movable. He was convinced he got a free drop and took that drop before I had a chance to say otherwise. Thankfully it was 4BBB and his partner recorded their best score for the hole so nothing needed to be decided.
