Where do i stand in this crash

Does anyone know of an accident where someone has said 'sorry this is entirely my fault'.

There is always two sides to every accident.
Thus said I hope you recover well.

I had no choice when I pranged my motor. Was pootling along on a wet road, and reacted a little bit late to the stationary truck in my lane.... went sliding into the back of him.

I looked like a right berk at the time, directing traffic with my car wedged under the back of a truck. I'd have looked a bigger berk if I got out and said "what did you think you were doing there? Stopped in my lane like that!" haha. Live and learn don't you. I understand insurance companies ask you not to accept blame, but let's be fair, nobody would have been able to argue a case in my favour for that one.

Wishing the OP a speedy recovery and resolution to his situation - hope the legal bill isn't too hefty.
 
I don't wish to put a downer on things but my car was hit from behind by a bus, I had to do an emergency stop after two kids ran out across the road, I stopped the bus didn't. My car was a write off, but because I had protected no claims, and I was insured with the same company that the bus was insured with, it was deemed knock for knock, and I had to pay for many sessions of physio for whiplash. The company was Norwich Union (now Aviva) and I have never insured anything through them since.

Having had a similiar experience with a different insurance group... I used a reputable claims recovery company the next time I got 'rear ended'... Insurers didn't like it but so what...
 
i used one as well when a taxi driver thought he would be a wise ass and pull out in front of me, while i was doing 55, they sorted everything, new car claim the works, they done all the running around for statements for deciding blame, op if you haven't already done so, use one!!
 
I was hit by an old dodderer in a B&Q car park. We were both with the same insurer and they wanted "knock for knock" and I absolutely refused., insisted on an engineer to agree whose fault and after a few arguments with the claims handler, won. Stick it out!
 
Well on Wednesday at 6:45 am I was on the. Roth circular in wembley near ikea riding along the middle lane and I remember seeing a set of big traffick lights so I started to ease of the accelerator when a silver golf cut straight in front of me and I tried my best to miss it but he cut me up to close and I went straight into the back or it him I THINK another car hit me up the arse and sent me and my r6 over the silver golf. I remember flying theough the air and the next thing I remember is a paramedic waking me up in a ambulance. I ended up in st Mary's hospital paddington with a fractured spine, bruised lungs, torn muscle in my left shoulder , broken right thumb in two places and a few cuts and bruises and I wasn't even going over 40 mph as I just passed a speed camera and the lights were next.
Friends and myself have been ringing the police since Wednesday to find what actually happened and the other drivers details so I can pass them on to my insurers which is only 3 party fire ans theft.
My question is who is at fault here ? Is it me as I went into the back of the golf BUT he did pull a dangerous manoeuvre to get in front of me, personally I think he didn't see me or even bother to look as if he did see me he would of waited to change lanes when safe to do so.

My memory has been a bit faint but its gradually coming back, I'm self employed so this is seriously damaging to the pocket.

Sorry if this has been covered, I haven't been able to read all responses.
I believe it is a myth that the driver that hits someone from behind is always at fault and I can't remember the exact word that is used when in court to determine the party at fault but I think it comes down to negligence or irresonible driving.

Hopefully you recover quickly and hopefully the law will stand behind the innocent party in this!
 
I see it as driving without due care as he pulled into my lane in my position so surely that's careless driving ?
Thanks for all the messages and tips and I won't give up without a major fight. The good news is today I got told they don't need to operate on my spine which is a massive relief and the bad news is the car at the front has claimed whiplash injury already, now the last time he saw me I was unconscious on the road with possible life changing injuries and he doesn't know if I'm alive or dead. I know everyone makes a whiplash claim but in this case I find it very disrespectfull. It makes my blood boil to think someone thinks like this and all he wants is a few grand.
I'm as poor as the next man but I wouldn't lie in this situation for a few quid. Honestly is the best policy.
I'm self employed and I can't provide for my family for the next couple of months so I will make sure he feels the full force of my hatred on him in the coming months and I will claim everything I can to make him cry.

Good news about there being no need for a spine op... Judging by an earlier post you've had an offer of some professional help/advice... Sure, you already know but there's usually plenty of good help/advice to be had on bikers forums...

Ive had a few near misses recently so now run with autoguard a phone app that allows you to record your drive. Can record speed and gps tracking as well as autodial the emergency services in a crash. Had just been using phone video before but this allows it to run in background. Hoping to never need to use it but have it incase I ever find myself in a similar situation.

Hope you get better soon. I know it's wrong, but nowadays if anyone gets hit from behind then the chances are they will claim whiplash injuries. There is a whole profession out there encouraging people to do so. It's widely acknowledged it's a awful situation, I read yesterday that whiplash claims put I think £90 on the annual premium of every driver in the UK. Honesty is the last think on most peoples mind when it comes to car accidents.

I think from that persons perspective they got hit from behind and they may or may not have whiplash. If they do then I know it may feel awful to you, but they have every right to claim from the person that hit them, and I suspect the quicker they can prove it after the accident the better. Of course if they do not have whiplash they are scumbags. But then again, as I said, there will be a whole profession trying to encourage that person to claim from you.

I'd try not to take it personally (difficult I know) and just concentrate on getting better.

Should that not be they have every right to claim from the person responsible for causing their injuries? Which may not be the same as the person who hit them. And if the OP's version is correct, then it sounds like the Golf driver should be claiming from himself as he is the alleged cause of the accident.
 
GolfDub, sorry to hear about the crash mate. Hope you get back on your feet soon. I had a rear ender just up the road from there in my car a year or two back, the bloke cracked my bumper, nothing too serious though!

Seems that the car who pulled out in front of you is the one at blame, had he not have done that there would have been no need for you to stop so suddenly. I hope it works out for you, keep us up to date!
