Law 12 is quite clear that striking or attempting to strike an opponent is a direct free kick and a red card is issuable for violent conduct. In this instant Clattenburk saw it as striking the opponent but didn't deem it violent conduct and I assume saw it more as a coming together and Rooney trying to muscle past.
Having refereed Saturday and Sunday football if you took the strict letter of the law on this you'd never get a completed game. However in a professional game like this I think having seen it to award the kick with the ball not in playing distance at the time surely it can't be anything other than violent conduict which isa straight red.
