Product guarantee and Ebay sellers

I bought a new mobile phone (Motog 8 plus) from ebay last November.
The battery has stopped charging (sealed unit so cannot change the battery).
I contacted the seller, thinking that I still have 3 moths guarantee left on the device but his reply was

“I'm not a retailer or shop and as such I can’t offer any warranty type service.
Maybe try the manufacturer?“


Is this legal? Can sellers get away with this? I would have thought, the fact that someone is selling something, that makes them a retailer.
Anyone with any experience of this type of issue and what would people suggest I do.

Were they a private seller ? You may find your options limited if they are, you could try a dispute, Ebay usually side with the buyer, although nearly a year on may be difficult.

I'm on the side of the seller on this one if is it a private sale.
You can't be giving out year warranties on sales like this, for me Ebay is a "sold as seen" to a degree.

All guarantees are with the manufacturer, if you buy from a shop they cover it and deal with the manufacturer for you as they can send it back etc

However you have bought from eBay which could be anyone..could be me at home selling a phone I got as s free gift

Will have to try Motorola

As above, buying off a private seller means that you take your chances. I've sold stuff on eBay which is in perfect working order however it may stop working in a month, 3 months, 6 months however I couldn't know and neither can the buyer. If something is clearly not working properly when you receive it then fair enough, anything breaking further down the line is just unfortunate.

Just done a quick Google, there are places offering a battery replacement service for your phone, there's also a kit with the battery and tools to do it for £20, I'd be all over that and watch some YouTube videos on how to do it.

Yep, that length of time really means it's down to buyer to sort out - and seller can't be held responsible.
With all due respect, who knows what sort of treatment phone has had since purchase.
Would you be happy to refund/fix if some asked for support from something you'd sold a year ago?

Ok thanks everyone. I just assumed that electronic stuff came with 1 year guarantee.
I'll be careful when buying expensive stuff off Ebay in the future and will ask questions before I buy next.
He/she was a private seller.

If it was a new product, then I'm not so sure the seller can walk away as a "private seller".
