OK, scenario for you:

Employee 'A' is on holiday. Employee 'A' checks the work BlackBerry and notices an e-mail detailing a problem at work.
Employee 'A' responds to said e-mail and, as a result, ends up dealing with a work query whilst on holiday.

Now, my question is, should Employee 'A's company 'refund' some of the holiday time due to the problem e-mail?

If Employee 'A' had been sick whilst on holiday then holiday can be refunded.

Not a chance. Employee 'A' took the work blackberry with them. Even if the blackberry is the employees only phone, the employee replied to the email.
Its give and take with employers. You do that extra bit and if you ever have to shoot off an hour or so early your employer will happily let you.

If Employee A is sad (or nosey) enough to take their work blackberry on holiday with them then they are just asking for trouble. I used to have to manage a financial advisor amongst my staff. She couldn't resist checking her work mobile daily while on annual leave for text messages she received from other parts of the business. She would then ring me at the office to discuss issues. I flatly refused to respond. Annual leave is a break from work and should be taken as such. No wonder there are so many stressy people around.

No it's a work phone so In my opinion the phone should've been switched off and left at work or all calls diverted to another colleague for them to deal with.

Taking a phone on holiday is pretty sad if I'm honest.

A decent boss will thank him for his diligence, and maybe refund some of the leave or give him some extra dosh. But in these days of ar5e covering the boss will also remind the employee leave is there to take a rest from work - duty of care.

I have to check my work emails at evenings and weekends but we aren't expected to do so while on annual leave. If I did then it would be my choice and they for sure wouldn't compensate me.
It's a bad idea to take the blackberry when travelling abroad anyway as the data costs can be massive for roaming blackberry's. A number of people at my company have been caught out by this.

If Employee 'A' had been sick whilst on holiday then holiday can be refunded.
This sounds like a pretty good deal. If we're sick while on holiday then it's tough luck and no holiday is refunded.
