A little help or advice...

OK so my inlaws car has been sent to a garage for a full service and MOT. The garage was told to do the work needed to get the car through its MOT. Its now been 2 weeks and the car has its MOT BUT, now the electric windows do not work, due to the garage trying to fix another problem they caused this one. My farther in law has refused to take the car till its fixed. The garage have given no idea of the bill but its expected to be a lot for work that did not need doing for the MOT or service. what are his rights ? does he just have to cough up the cash? or can he dispute the work done...

I run the only garage in Medway approved by trading standards so feel qualified to comment.

They should not have done work not relating to the service/mot if that is what was requested, however prooving this is hard.

What did they attempt to fix that caused a problem with the electric windows?

If he wants to get his car back he will have to pay the bill. He should then form any case he feels he has in writing with a complaint based on the supply of goods and services legislation. Should the complaint not be resolved the next step is to contact consumer direct and take it from there.

the problem you will have is that the garage was given carte blanche to do whatever needed doing to pass the MOT. As such, nothing in the car is off limits, or outside the agreed scope of work. Therefore, they could touch anything in order to get it through the MOT.

Ironically, if the windows don't need to work to pass the MOT, they have actually fulfilled their part of the bargain and the bill should be paid! Work to rectify the windows may be liable for extra charges, as it is a separate piece of work; this is even more likely to be the case if you cannot prove they have caused the windows to stop working.

This obviously seems extremely unfair on the face of it, but your legal position is very uncertain, as they haven't gone outside the level of authorisation they were originally given. Best you can really hope for is that the windows can easily be fixed (just a wire cut accidentally or something), and they charge a minimal amount to rectify it or do it for nothing out of goodwill - john will be able to tell you how likely that is!

The car went in with a number of faults that were pointed out, and fixed. The windows worked fine before the car went in to be sorted. The 2 front doors however did not, when you opened eith on the central locking would continue to open and close till the door was closed again, The garage was asked tyo take a look at it and see if its a simple fix, if not then dont bother with it.

He spent 3/4 days trying to fix the doors and while trying to fix the doors the windows stopped working.

Over 2 weeks now and still not done.

OK,

The car was collected today and teh garage have not charged my farther in law for the many hrs work he done trying to fix the central locking and the electric windows, he charged a fiar rate for the work done for the service and MOT.

However the electric windows no longer work and the garage has not been able to get them working, also when the car was collected it went all of half a mile and the car would not change gear, its an Auto.

It was turned around and taken back where we were told its because the car has been stood for 3 weeks (please i know thats not the case)

Everything worked OK, till he messed about with the electrics and now the windows do not open and the gearbox seems to be playing up.

My farther in law has taken it to a Merc specialist and they have said this fault is electrical caused by the work done by the garage. They will now have it for 1 week to try and fix all the problems.

Should we Bill the garage for the work now being done to the car >? all problems caused by them.????

if you want to do that you will need the Merc garage to put in writing the cause of the faults in some detail, the other garage is cr*p won't be sufficient.

if he's a member of the RAC or AA he should get in touch with them.
