Smokers in England and Wales can now be fined £50 for lighting up in a car when children are present.

The new law is hailed as a landmark in protecting children but police say they will only warn drivers - not fine them.

??????????????????????????????????????????..

So whats the point then ?

Grace period imo, eventually they will.

Agreed.. Can't quite work out whether it's a good law or not.. What's worse, smoking in a car with the windows open or smoking in a front room with little air circulation? The other thing is that this will undoubtedly lead to calls for smoking whilst pregnant to be looked at.. Now that's a whole can of worms to be opened..

Good thoughts on 5 live by derby and humberaide police.

It seems to be a mopping up law and they said will be mostly self policed.

I certainly think smoking in confined spaces is bad and should be discouraged but I highly doubt anyone will get anything more than a fine.

Let's educate to solve problem like this rather than just treat the symptoms with laws that are hard to police.

How do you tell if the driver is 17 or 18?

Unenforceable... and do you want PC Plod lecturing someone at the roadside or attending a burglary? More laws and less Police out there...

Agree, however, it if stops 8/10 people doing it, then just the passing of the law is enough. It will become (already is in my eyes) unacceptable to smoke in a car with children in.

So if the driver is alone in the car but is 17 years old then he's breaking the new law if he smokes in front of himself :D

I think that is pretty much what the police were saying, social changes have modified most peoples behaviour, just passing the law will mop up a good portion of those who still did before the law came in.

Great!! Why would you ever smoke in a car with a child?

Who in their right mind would choose to smoke in a car while their children were also there?

A lot of people - only have to look when you are out driving

It's still unbelievable that some still smoke when they are pregnant

I think the collective belief is that an 'occasional puff' that keeps Mum from becoming a jibbering wreck is better for the overall health of the foetus/child. Same applies to alcohol.

While I applaud another move 'against' smoking, there's a little of me that objects to the nanny-state mentality of this issue!

Is vaping ok? The banning of vaping on stations seems wrong to me - though ambivalent about use in carriages. And I guess if the smoker is actually the 17 yo in the back of the car, then that's illegal too!

Not going to be long before smoking on Golf Courses will be illegal - I'll miss the wonderful aroma of cigars - but not the non-biodegradable cig butts!

I think the problem is that some people are so feckless and stupid that they need telling what to do when the rest of us see it as basic common sense. Hence we then feel it's the nanny state interfering. When in most cases I am sure the nanny says to herself 'Oh Jesus wept, really, do I really need to tell a bunch of knuckle draggers that puffing away on fags when your child is in the car inhaling the crap it throws out is a bad thing? God this is hard work. And don't get me started on the lard arses having KFC and coke for tea every night, how many times?? '
