I recently bought a driver new from a pro shop on eBay. I got it home took it out of the box and gave it a waggle. Hmnnnn this feels on the stiff side I thought so I taped it up as a pro would if you wanted to try one in a shop or range. I hit 5 balls with it, hand on heart. It was too stiff for me. No distance or height on the shot.
I rang the shop and explained the situation. They said fine, send it back and we will refund you. Great. I arranged a courier and sent it back with a covering email. I got a reply today saying they will not except it back as it is now second hand as I have hit it taped up or not. I said c`mon, I have hit loads taped up and the pro has always sold them ones on as new, what about the racks of putters people have tried out before someone finally buys it?
I will have to see when they get it tomorrow but it doesn't seem right to me as it doesn't have a single mark on it, no one else could possibly know it had been hit.
 
Why did they say they'd offer a refund & then change their mind? Can you not get it replaced for regular flex?
It does seem unfair if the club as no marks,not sure what your rights are tho tbh mate. Good luck with it.
 
Did you just tell them it was too stiff - without telling them you'd hit a few balls with it?
This is the only scenario where I would think they would refuse a refund. Obviously, if you had bought a club erroneously with the wrong flex (PROVIDED YOU DIDN"T HIT IT) they would refund or replace with the right flex. Once they had discovered it had been used, then by definition it's now second hand :(
Either way, Ebay is getting a right pain these days - I much prefer good old fashioned pro shops where you can talk face to face with the seller.
On the other hand, why by anything new without finding out first if it were suitable? And hand on heart, if I owned a shop and all I got were tyre kickers who tried out gear and gave it back expecting a refund when it didn't meet their own expectations - yes, I be slightly pissed off too.
Two sides to every story I guess?
 
by definition it's used, and therefore not new.

from your description of events they said send it back in relation to the phone call, subsequently got information in your email that caused them to respond and, importantly, are still waiting for the returned club.

if it is completely unmarked in any way I suspect they will just refund - if it isn't they will advise options.

no doubt you will let us all know in due course.
