eBay purchase, am I'm being unrealistic?

I recently purchased a 5 wood from eBay and upon receipt of the item I was left very unsatisfied. A few messages passed back and forth with the seller but in my opinion they have the attitude of " I have your money do one"

As I explained to the seller at no point in the item description is there any reference to excessive wear marks or face wear, nor is there any mention of the top of the club being covered in glue or some sort of resin.

The seller believes that the item being described as used should be sufficient and if I had any concerns about the condition I could have asked for images of worry areas. Why I do agree with this as I said to them as no excessive damage was mentioned I had no reason to think otherwise and was using my 2 1/2 season model as a example of average condition.

It's gone to dispute but the seller is refusing to back down..... So I know it's going to go the full hog with eBay having to make the decision, my question is am I being unreasonable,

A case of buyer beware perhaps.
A lot of things about that listing would have rang alarm bells for me. A single, odd angle picture and no real description other than standard this and that.
One of the dangers of buying on eBay, I hope eBay/Paypal see sense but I wouldnt hold my breath as the item IS used afterall and while I agree the listing doesnt say it is damaged, nor does it claim its not damaged.

I have seen Paypal disputes be ruled in seller favour based on the above. Good luck with the case.

I'm kinda with the seller here, there are no promises made about the condition and to bid on an auction with so little detail is asking to be disappointed. I'd have at least asked for a pic of the face. Out of interest was this a last minute spot, I've seen you be very careful about buying used items previously?

I do however completely agree that the condition is far worse than used, and would be following the exact same path as yourself if something like that landed on my doorstep. The seller should be ashamed.

I've offered a partial refund option in favour of ending the case which is around the same amount as the return postage but being someone that takes care of their clubs I'm not sure I can look down on this club,,,, it just doesn't sit well on the eye

Your right I should have taken my own listings as an example, as they say never assume.

I'm not sure you have a case as it the wear was stated as cosmetic which, I guess, it is - the black face just makes it more obvious. The Seller was in the wrong for not giving more details and offering more photos to show the true extent of the wear. Good luck with the appeal, in my experience the buyer tends to be favoured.

This is the route I have gone down, I have explained to eBay that the seller obviously planned to mislead as he hasn't taken images or mentioned in the description anywhere about excessive paint scratches or resin marks, the used with cosmetics is a general eBay statement which you can select as an auto option.... Not one that's been actively inserted.

Is there not a 14 day period , if i understand consumer laws there is a 14 day cooling off period .............do come back and update us , thanks

any way it will clean up OS? I would just try and make it look better then pump it back on ebay.

I am sure I can give some lessons in ebay buying, never been bitten yet and always got my dosh back when reselling

Ebay are gits, I had a dispute against me over some wedges, sold em for a bargain and the bloke reckoned the wear was more than described... they were smoke, the black had faded slightly on the faces! Ebay threw it out so I was ok.

Stuart...I can only assume that the club has been used with dirty balls or very worn balls which have worn the face excessively quicker.

Is the 'resin' definitely something like that or could it just be baked/caked dirt from little to no cleaning of the club? I once got a club that looked very similar, stuck the head in hot water for 5 mins and then gave it a rub with a towel and it came up looking well.

Not saying that's what you should do or anything but just incase ebay don't find in your favour maybe you could get it cleaned up a bit and maybe even paint fill the face lines to freshen it up?

Looks like the previous slicer has been hitting rocks with it! That's a bit more than cosmetic IMHO. Hope you get a favourable result but could be difficult.
