The Head Gardener is having a spat with Ebay seller.

She ordered a cable, they sent the wrong one which she sent back as instructed.
They have not replaced and have refused to refund postage costs, according to them as Ebay guidelines.

Can this be right or are they having a laugh?
 
I know they don't have to refund the original postage costs if you wanted to return the item. But as it was their error I find it hard to believe you should have to pay for returning it. Send eBay or PayPal an email see what they say. If PayPal agree in your favour they will refund it as long as you have proof of the return cost.
 
Depends, if she has received a refund for the item then they do not need to replace. If she hasn't then she needs to raise a dispute in the resolution centre.
If it states in their returns policy that returns are accepted at the buyers expense then tough, you should read the returns policy first.
If the returns policy does not state this then she needs to raise a dispute through the resolution centre. Although I can't imagine postage costs for a cable would be a lot, I take it it's the principle?

A return is a return, some of the ebay sellers have gotten quite clever in how they are wording the returns policy.
One of the conditions of return on many is "If, for any reason, you receive an incorrect item..." often followed by a unilateral "you pay for postage" statement. Whether it's morally right or wrong, if you buy from the seller you are accepting their T&C's.

As above, whiffy/nonsense or not, always best to check the returns policy as one bought you are tied by whatever they put in there as long as it falls in line with the SOGA. Been stung a couple of times in the past by some terrible wording in the T&C.

Ebay are very keen on telling you that when you purchase anything you enter a legally binding contract. Since the seller hasn't fulfilled their part of the contract I would say that is not a return as you cannot "return" what you technically haven't had.

As I said, it depends on the T&C of the return policy. I'm not claiming that it's morally right. I sadly was stung a couple of times and ebay's response was "be careful that you check the T&C next time as you are bound by it" due to the nature of the variance of what ebay allow to be sold, there is no unilateral set of terms that protect you in every case.
 
I'd imagine telling them your rating of them is going to be diabolical should make them see sense that they are wrong and their customer is right.

£2?? I'd have popped mi hand in mi pocket mi sel and give it to her if it upset her that much, particularly being so special, principals or not. Sounds like there are brownie points to be had....


She'll know for next time to send a minion to the shop to spend an extra 60% on whatever. Bet she wouldn't complain about paying their distribution costs etc...


And surely she'd claim it back on her expenses, what, being the Head Gardener an 'all.


Understand if it was major cash but jeez, give her the latest edition of Rake monthly or sommat, show her the bargain hoe page and make her a cup of lovely Horlicks. She'll be rite then. Either that or tell her to visit here...

If they are a Powerseller, they ill be very concerned about their Feedback (as their fees are cheaper), so a threat of Negative Feedback could well produce results.

You may have agreed to their terms, but it's still their blunder. It should be their cost rather than yours.

If no reaction, leave (honest) negative feedback. An Ebay/Paypal claim may produce results too.

According to Ebay if you order a pair of size 9 golf shoes and they send you a pair of size 7 you are supposed to return the goods AND pay for the postage. Even if they do not have a replacement.
 
Not always

A while back I got sent a wrong club.
Contacted the seller, he arranged and paid for return postage (all I had to do was drop the parcel at the local Hermes drop-point) and the proper club came 2 days later.....

Depends on the supplier - a decent one will pay if they've messed up.

Keep pushing it...

And, ok it's only £2 but if it's not challenged it's a great way to make money!!

Ah, so it's a legally binding contract except when it suits Ebay and the seller then? Thanks for that Doon, worth knowing for future reference.
