Dissolution of Main Club, what happens to the Seniors section

A question to you legal eagles. A friend of mine is a committee member of a local, small 9 hole club

The problem is players are migrating in their droves to the senior section and the younger players are leaving to bigger courses. The committee were seriously considering winding up the main club with the county's golf union

The main club comps can barely muster a dozen players while the senior section is thriving, fielding 30 players on average per comp, as the Main club contributes funds to the senior section in its constitution, he feels they are no longer in a position to do so

With the lack of players the reserve funds are being depleted

If the Main club was to wind up what would happen to the senior section?

Everything will depend on the constitution.

Normally the seniors are a section, but in some cases they are a club in their own right.

Sounds like they are a section here, and in the majority. So they should simply vote first not to wind it up, then take over!

If this sounds a little glib there will be so so many questions to make any real telling points. If the issue is serious then they should be getting proper legal advice.
 
Thanks Duncan. Yes they are in the majority and officially a section. The constitution states that the club donates to the senior section to semi fund them but they have a larger income from comps than the main group. I can see where my friend is coming from

It sounds like they would want to keep their senior status ie 55 and over and wouldn't want to be open to all ages

Seems a good club debate is required

I'd rather not say, I was told in confidence but I can say it's basically owned by a public school as a playing field with a full time greenkeeper

A long time ago a large group of social payers wanted to play in competition so approached the county golf union to ratify the ground where players can get an official handicap

Most of these players are now in the senior section. about 4 years ago the main club was thriving with a lot of high cappers but as they improved they moved to a better course, as it's deemed a beginners course people do move on but no new bodys are joining

So I guess the founders are in the seniors so should have a good shout in the future of the club

Sorry to be a little evasive but it might spook some people if they connected the post to the club

As for the original question....It does all depend on the constitution!

It may be simply a case of amending it as required. Or it may be a case of winding up and re-forming. But a properly formed constitution should cover how either is done. And there are procedures to be followed about withdrawing from (and possibly re-affiliating to) Congu too.
